1. Introduction

Welcome to FunKids Agency. These Terms of Service ("Terms") govern your use of our website and services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our services.

FunKids Agency is a professional children's event organization company based in Perth, Australia. We are committed to providing high-quality, safe, and enjoyable experiences for children and families. These Terms apply to all users of our services, including but not limited to clients, website visitors, and event participants.

2. Services Description

FunKids Agency provides professional children's event organization services, including but not limited to:

• Birthday party planning and execution
• School event coordination
• Seasonal celebration organization
• Custom themed party design
• Entertainment services
• Decoration and venue setup
• Activity coordination and supervision

All services are subject to availability and must be booked in advance. We reserve the right to refuse service at our discretion.

3. Booking and Payment Terms

To book our services, clients must complete a booking form and provide all required information. A non-refundable deposit of 30% of the total service fee is required to confirm your booking. The remaining balance must be paid no later than 7 days before the scheduled event date.

Payment can be made via bank transfer, credit card, or other approved payment methods. All prices are in Australian Dollars (AUD) and include GST unless otherwise stated. Late payments may result in cancellation of services and forfeiture of deposit.

Price quotes are valid for 14 days from the date of issue. After this period, prices may be subject to change based on availability and market conditions.

4. Cancellation and Refund Policy

Cancellations must be made in writing via email to [email protected]. The following cancellation fees apply:

• More than 30 days before event: Full refund minus deposit
• 15-30 days before event: 50% refund of total payment
• Less than 15 days before event: No refund
• Deposits are non-refundable under all circumstances

FunKids Agency reserves the right to cancel or reschedule events due to circumstances beyond our control, including but not limited to severe weather, natural disasters, or public health emergencies. In such cases, clients will be offered alternative dates or a full refund.

5. Client Responsibilities

Clients are responsible for:

• Providing accurate information about event requirements, guest count, and special needs
• Ensuring venue access and adequate space for planned activities
• Informing us of any allergies, medical conditions, or special requirements of participants
• Supervising children at all times during the event
• Ensuring guests behave appropriately and follow instructions from our staff
• Providing necessary facilities such as electricity, water, and restroom access
• Notifying us of any changes to booking details at least 7 days in advance

Failure to fulfill these responsibilities may affect the quality of service delivery and may result in additional charges.

6. Liability and Insurance

FunKids Agency maintains comprehensive public liability insurance. However, we are not liable for injuries, accidents, or damages that occur due to negligence on the part of clients, guests, or venue conditions beyond our control.

Parents and guardians are responsible for supervising their children at all times. While our staff will coordinate activities and maintain a safe environment, we cannot be held responsible for accidents resulting from children's behavior or failure to follow instructions.

Clients are responsible for any damage to our equipment, decorations, or materials caused by guests or participants. Repair or replacement costs will be charged to the client.

Our liability is limited to the total amount paid for services. We are not liable for indirect, consequential, or punitive damages.

7. Intellectual Property

All content on the FunKids Agency website, including text, graphics, logos, images, and software, is the property of FunKids Agency or its content suppliers and is protected by Australian and international copyright laws.

You may not reproduce, distribute, modify, or create derivative works of our content without express written permission. Our custom designs, themes, and creative concepts remain our intellectual property even after event execution.

Clients grant us permission to photograph and video events for promotional purposes unless they explicitly opt out in writing before the event.

8. Privacy and Data Protection

We collect and process personal information in accordance with our Privacy Policy and the Australian Privacy Principles. By using our services, you consent to such processing and warrant that all data provided is accurate.

We will not share your personal information with third parties except as necessary to deliver our services or as required by law. For more information, please refer to our Privacy Policy.

9. Modifications to Terms

FunKids Agency reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of the modified Terms.

10. Governing Law
